Unboxing Web3 LLC (“Company,” “we,” “us,” or “our”) operates the Unboxing Web3 platform, offering digital experiences, sweepstakes, and blockchain-based engagement tools. By accessing or using our website, services, or participating in any promotions (collectively, the “Services”), you (“User” or “Participant”) agree to comply with and be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not use our Services.

2. Eligibility

2.1 General Eligibility

To use our Services, including sweepstakes and promotional events:

You must be at least 18 years old (or the legal age of majority in your jurisdiction, whichever is higher).
You must be a legal resident of the United States (except for restricted states or jurisdictions listed below).
Employees, contractors, and immediate family members of Unboxing Web3 LLC are not eligible to participate in sweepstakes.

2.2 Restricted Jurisdictions

Sweepstakes, raffles, and promotions are void where prohibited. Participants must not reside in:

States that restrict sweepstakes participation (including but not limited to Rhode Island, New York, Florida (for prizes over $5,000), and Washington).
Countries or territories under U.S. sanctions, including Cuba, Iran, North Korea, Syria, and Crimea (Ukraine).
Jurisdictions where participation would require additional licensing, regulatory approval, or legal compliance beyond our operational scope.

We reserve the right to disqualify entries from restricted jurisdictions.

3. Sweepstakes & NFT-Based Entry

3.1 No Purchase Necessary

Unless explicitly stated otherwise, all sweepstakes conducted by Unboxing Web3 LLC do not require a purchase to enter or win. A purchase will not guarantee a win, but purchasing additional entries provides more chances to win in accordance with the number of entries received.

3.2 Entry Methods

Participants may enter sweepstakes by:

Completing designated engagement tasks (e.g., following social media accounts, sharing content, referring users).
Free Entry via Alternative Method of Entry (AMOE)
- Participants may also enter by submitting a form available at www.unboxingweb3.com to receive 5 free entries (one-time submission). Limit one form submission per person per item.
Paid Entry Bundles (Optional)
- Participants may purchase additional entries as follows:

■ 10 entry bundle // $5 // $.50 per entry

■ 30 entry bundle // $12 // $.40 per entry

■ 75 entry bundle // $25 // $.33 per entry

■ 150 entry bundle // $40 // $.27 per entry

Owning or using NFTs as an entry mechanism in designated sweepstakes.

3.3 NFT-Based Entry & Participation

Some sweepstakes may allow or require participants to use Non-Fungible Tokens (NFTs) for entry. If applicable:

The official sweepstakes rules will specify which NFTs qualify for entry.
The participant must verify wallet ownership through a signature confirmation.
NFT ownership does not guarantee winning; all sweepstakes are subject to randomized selection.
Unboxing Web3 LLC does not control secondary NFT markets or guarantee the future value of NFTs.
NFTs used for entry may not be transferable or refunded once entered into a sweepstakes.

3.4 Winner Selection & Notification

Winners are chosen via a randomized drawing process unless otherwise specified.
Winners will be notified via email and must respond within 48-72 hours to claim their prize.
If a winner does not claim their prize within the allotted time, the prize may be forfeited at the Sponsor’s sole discretion. The Sponsor reserves the right to either select an alternate winner or retain the prize for a future giveaway or promotion.
Winner is responsible for shipping costs.

3.5 Prize Restrictions & Substitutions

Prizes cannot be exchanged for cash or transferred to another party.
If a prize becomes unavailable, we reserve the right to substitute it with a prize of equal or greater value.
For prizes valued at $600 or more, winners may be required to submit a W-9 tax form for IRS reporting.
No individual prize offered in these sweepstakes exceeds a total value of $5,000. As a result, this promotion is not subject to the sweepstakes registration and bonding requirements of the Florida Department of Agriculture and Consumer Services.

3.6 Shipping & Delivery

Prizes are only shipped to eligible U.S. addresses.
We do not ship to O. boxes, military addresses (APO/FPO), or restricted jurisdictions.
Unboxing Web3 LLC is not responsible for lost, damaged, or undeliverable shipments due to incorrect address details provided by the winner.

4. Prohibited Conduct

By using our Services, you agree not to:

Engage in fraudulent activities (e.g., creating fake accounts, using bots, or exploiting system vulnerabilities).
Violate any federal, state, or international laws regarding sweepstakes, raffles, and digital promotions.
Interfere with or disrupt our platform, including hacking, scraping, or attempting unauthorized access.

Violation of these Terms may result in disqualification, suspension, or legal action.

5. Limitation of Liability

Unboxing Web3 LLC is not liable for technical errors, lost entries, or system malfunctions that affect sweepstakes participation.
By entering a sweepstakes, you release and hold harmless Unboxing Web3 LLC from any claims, damages, or losses related to participation.
We do not guarantee uninterrupted or error-free services.

6. Privacy & Data Collection

Our Privacy Policy governs how we collect, use, and store personal data. By using our Services, you consent to:

The collection of necessary data for sweepstakes entry, winner verification, and prize fulfillment.
The non-sale of personal data to third parties, except as required by law.
The option to unsubscribe from marketing communications at any time.

7. Dispute Resolution & Governing Law

7.1 Governing Law

These Terms are governed by and interpreted under the laws of the State of Florida, without regard to conflict of law principles.

7.2 Dispute Resolution

Any disputes shall be resolved as follows:

Informal Resolution: Contact unboxingweb3@gmail.com to resolve disputes amicably.
Binding Arbitration: If unresolved, disputes shall be settled via binding arbitration in Florida under the rules of the American Arbitration Association (AAA).
No Class Actions: Users waive the right to participate in class action lawsuits related to our Services.

8. Amendments & Updates

We reserve the right to modify these Terms at any time. Updates will be posted on our website, and continued use of our Services constitutes acceptance of the revised Terms.
